Terms & Conditions

These Terms and Conditions govern the consulting and support services provided by DIGINOAIR in the context of remote living and location-independent work.

1. Scope of Application

(1) These Terms and Conditions apply to all contracts between DIGINOAIR (the “Provider”) and its clients (the “Client”) regarding consulting, planning, and support services related to remote living and location-independent work in the Republic of Korea.

(2) Deviating terms and conditions of the Client shall not apply unless expressly agreed to in writing by the Provider.

2. Scope of Services

(1) DIGINOAIR provides consulting, planning, informational, and support services only, including but not limited to:

  • individual consulting and needs assessments
  • location, lifestyle, and remote-work guides
  • recommendations for accommodation, coworking spaces, cafés, and services
  • support with organizational topics (e.g. SIM/eSIM, local apps, daily setup)
  • concierge-style assistance within the scope of consulting

(2) DIGINOAIR is not a travel organizer and does not provide package travel services.

(3) DIGINOAIR does not broker or arrange accommodation, flights, insurance, visas, immigration services, or third-party services, and does not conclude contracts on behalf of the Client.

(4) All recommendations are non-binding. Any booking or payment to third parties is carried out exclusively by the Client.

3. No Legal, Tax, or Visa Advice

DIGINOAIR does not provide legal, tax, immigration, or official visa advice. Any related information is for general guidance only and does not replace advice from qualified professionals or official authorities.

4. Conclusion of Contract

A contract is concluded when the Client accepts an offer in writing, clicks an acceptance/checkout confirmation (if applicable), or when the agreed fee is paid—whichever occurs first.

5. Fees & Payment Terms

Fees are based on the selected package or the individual offer. Unless otherwise agreed, prepayment applies and services commence only after receipt of payment. If prices are displayed on the website, any included/excluded taxes (e.g., VAT) will be indicated where applicable.

6. Client Cooperation Obligations

The Client must provide all required information completely and correctly. Any delays or additional effort caused by missing or incorrect information shall be borne by the Client.

7. Liability

DIGINOAIR shall be liable only for intent or gross negligence to the extent permitted by applicable law. DIGINOAIR assumes no liability for third-party services, providers, platforms, venues, landlords, or authorities, and no liability for outcomes dependent on third parties (e.g., availability, pricing changes, approvals, visa decisions).

8. Cancellation, Withdrawal & Refund Policy (Korea)

(1) If the Client is a consumer and the contract was concluded as a distance/online transaction, statutory withdrawal (cooling-off) rights under the applicable Korean consumer protection rules may apply. Where such statutory rights apply, the Client may generally withdraw within the legally permitted period, unless an exception applies (e.g., services already commenced with the Client’s prior request/consent, or other statutory exceptions).

(2) For scheduled consulting calls and time-based services: If the Client cancels more than 7 days before the agreed start time, any paid amount will be refunded minus reasonable payment processing fees (if applicable). If cancellation is made within 7 days of the agreed start time, or if the service has already commenced, the paid fee may be non-refundable or partially refundable based on work already performed.

(3) For delivered digital materials (e.g., PDFs, checklists, curated lists) and custom plans: once the materials have been delivered or the planning work has started, refunds may be limited or excluded to the extent permitted by applicable law, especially where the Client has requested early performance.

(4) Any mandatory consumer rights remain unaffected.

9. Intellectual Property & Usage Rights

All materials are protected by copyright and other intellectual property laws. Usage is limited to the Client’s personal/internal purposes. Redistribution, resale, publication, or sharing with third parties is prohibited without prior written consent.

10. Confidentiality

Both parties agree to treat all confidential information as confidential, even after termination. This does not apply to information that is publicly known or must be disclosed by law or a competent authority.

11. Data Protection (Korea PIPA + GDPR where applicable)

Personal data is processed in accordance with applicable data protection laws, including the Korean Personal Information Protection Act (PIPA). Where applicable (e.g., EU/EEA Clients), GDPR principles may also apply. Details on categories of data, purposes, retention, and data subject rights are provided in the Privacy Policy.

12. Force Majeure

DIGINOAIR shall not be liable for delays or failures due to events beyond reasonable control (e.g., natural disasters, governmental measures, network outages, strikes, platform failures).

13. Governing Law & Dispute Resolution (Korea)

(1) These Terms and Conditions and the contractual relationship shall be governed by the laws of the Republic of Korea, excluding conflict-of-law rules, to the extent permissible.

(2) For consumers, mandatory consumer protection provisions and mandatory jurisdiction rules remain unaffected. For all other cases, the competent courts at the Provider’s registered office in the Republic of Korea shall have jurisdiction.

14. Amendments to these Terms

DIGINOAIR may update these Terms and Conditions from time to time. The version published on the website at the time of contract conclusion applies. If material changes are made for ongoing contractual relationships, DIGINOAIR will provide reasonable notice where required by law.

15. Severability Clause

If any provision is invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent, to the extent permitted by law.
