(2) DIGINOAIR provides its services internationally and completely remotely.

(3) Any deviating terms and conditions of the Customer shall not apply unless the Provider has expressly agreed to them in writing.

2. Scope of services

(1) DIGINOAIR provides digital information products and, where expressly included in the purchased package, defined remote guidance and decision-support services in connection with living and working in Korea. These include, among other things:

  • Self-guided digital guides and resources
  • Individual review and decision support where expressly included

  • Structured written answers and updates within the stated package scope

(2) Services are provided exclusively remotely, unless expressly agreed otherwise.

(3) DIGINOAIR is not a tour operator, broker, agent or intermediary within the meaning of applicable travel or agency law.

(4) DIGINOAIR does not arrange accommodation, flights, insurance or other services in the legal sense and does not conclude any contracts on behalf of the customer.

(5) All bookings, contracts, registrations and payments are made exclusively directly between the customer and the respective third-party providers.

(6) Recommendations and information are provided for guidance and decision-making support only.

(7) The specific scope of services is determined exclusively by the package purchased by the Customer and the written order confirmation or offer.

(8) Any services, features or partner-based support described on the Website as “planned”, “coming soon”, “future”, or with similar wording are provided for information purposes only and do not form part of the contract unless expressly confirmed in writing by DIGINOAIR.

Common exclusions

(9) Unless expressly identified as an activated and separately agreed partner-delivered service, DIGINOAIR does not:

  • Make bookings, purchases or payments on behalf of the Customer
  • Submit applications, registrations, appointments or forms
  • Negotiate with landlords, providers, financial institutions or authorities
  • Provide live chat, on-demand availability, emergency assistance or unlimited follow-up
  • Make legal, immigration, tax, financial, insurance, medical, eligibility, suitability or credit decisions
  • Guarantee approval, availability, pricing, provider performance or any particular result

(10) The Customer remains responsible for all final decisions and for communicating, contracting and paying directly with third-party providers and authorities.

(11) A partner-delivered service forms part of the contract only when it has been activated and is expressly described in a written service description, order confirmation or separate agreement. The scope, responsibility, fees and applicable exclusions for that service will be stated separately.

3. Package scope and support period

The purchased product page and order confirmation define the included scope.

Signature Package

Signature is not currently available for purchase. Waitlist descriptions and future feature announcements do not form part of a contract.

Only services expressly listed on the purchased product page, in the order confirmation or in a separate written agreement are included. All support is remote unless expressly stated otherwise.

4. No legal, tax or visa advice

DIGINOAIR does not offer any legal, tax, immigration, insurance or medical advice. In particular, no information provided by DIGINOAIR replaces advice from:

  • a licensed solicitor
  • a tax advisor
  • an immigration or government authority

This applies to information about Korea as well as other countries.

5. Conclusion of contract

A contract is concluded when:

  • the customer accepts an offer in writing or
  • the agreed fee is paid.

6. Fees and terms of payment

(1) Remuneration shall be based on the respective offer or the current price list.

(2) Unless otherwise agreed, the following shall apply:

  • 100% advance payment
  • Commencement of service provision after receipt of payment and, where mandatory for the purchased package, submission of the completed onboarding form

(3) Prices are in USD, unless otherwise stated.

7. Customer’s obligations to cooperate

(1) The customer undertakes to provide all information necessary for the provision of services in a complete and truthful manner.

(2) Delays or additional expenses due to incomplete or incorrect information shall be borne by the customer.

Mandatory onboarding for Explorer and Signature

(3) Completion of the onboarding form is optional for Customers who purchase the Essential Package.

(4) Customers who purchase the Explorer or Signature Package must complete the DIGINOAIR onboarding form within 14 calendar days after payment.

(5) The onboarding form must be completed truthfully and with all information reasonably required for the provision of the personalised services included in the purchased package.

(6) If the required onboarding has not been completed within the 14-day period, it will be marked as overdue and a final grace period of 2 additional calendar days will apply. The form will remain available during this grace period.

(7) If the onboarding remains incomplete after the grace period, the Customer’s package access will automatically be changed to the Essential Package. The Customer will retain access to the services and materials included in Essential, while services exclusive to Explorer or Signature will no longer be available.

(8) In the event of such a change, the applicable difference between the package price actually paid and the Essential Package price applicable to the order will be refunded. Discounts and applicable taxes will be taken into account. Separately purchased add-ons and third-party costs are excluded from this calculation.

(9) The refund will be processed through the original payment method without undue delay. Processing times imposed by banks or payment providers are outside DIGINOAIR’s control.

(10) No package change will take place if the required onboarding is completed before the end of the grace period. Any extension of the onboarding deadline requires written confirmation from DIGINOAIR.

8. Cancellation and withdrawal

(1) Consumers may cancel an order within 7 days from the date on which they receive the contract information required by applicable Korean law or, where supply begins later, from the date on which the supply of the goods, services or digital content begins, unless a statutory exception applies.

(2) The right of cancellation may be restricted after the provision of a service or digital content has begun, but only to the extent permitted by the Act on the Consumer Protection in Electronic Commerce and only where DIGINOAIR has clearly informed the Customer of the restriction and taken the measures required by law. For divisible services or digital content, any statutory right relating to portions not yet supplied remains unaffected.

(3) Where the supplied service or digital content differs from its description, advertising or the agreed contract terms, the Customer may exercise the cancellation rights available under applicable law, including the relevant extended statutory periods.

(4) Following a valid statutory cancellation, DIGINOAIR will make the required refund within the period prescribed by applicable Korean law. Where services or digital content have already been partially supplied or used, DIGINOAIR may deduct or claim only those amounts permitted by law.

(5) Nothing in these Terms excludes or limits any mandatory consumer rights that apply to the Customer. Cancellation, withdrawal and refund rights may differ depending on whether the purchase is digital content, a service or a combined product, when performance begins and the law applicable to the Customer. Any valid statutory right remains unaffected. The separate package adjustment under Section 7 remains unaffected.

9. Liability

(1) DIGINOAIR is liable in accordance with applicable Korean law. Nothing in these Terms excludes or limits liability for intent, gross negligence, personal injury, breach of mandatory statutory obligations or any other liability that cannot legally be excluded or limited.

(2) To the extent permitted by law, DIGINOAIR is not responsible for independent decisions, bookings, contracts or payments made by the Customer, except where loss is caused by DIGINOAIR’s breach of contract or other legally attributable conduct.

(3) DIGINOAIR is not responsible for the independent performance, availability, pricing or actions of third-party providers with whom the Customer contracts directly, unless responsibility arises under mandatory law or an expressly agreed DIGINOAIR obligation.

(4) Recommendations are decision-support information and do not guarantee any particular outcome. This clause does not exclude liability where exclusion would be prohibited by applicable law.

10. Intellectual property and rights of use

All materials, guides, documents and content provided are protected by copyright. Use is permitted exclusively for the customer’s personal, non-transferable purposes. Any disclosure, publication or commercial use is not permitted without the express consent of DIGINOAIR.

11. Confidentiality

Both parties undertake to treat all confidential information received in the course of their cooperation as confidential, even after the termination of the contract.

12. Data protection

Personal data will be processed in accordance with the Personal Information Protection Act of the Republic of Korea and other applicable data protection laws. Where the GDPR or another mandatory foreign data protection regime applies to a particular Customer or processing activity, DIGINOAIR will also comply with those requirements. Further information can be found in DIGINOAIR’s privacy policy.

13. Force majeure

DIGINOAIR is not liable for delays or performance disruptions caused by events of force majeure.

14. Applicable law and place of jurisdiction

(1) These Terms and the contractual relationship between DIGINOAIR and the Customer are governed by the laws of the Republic of Korea.

(2) This choice of law does not deprive a consumer of mandatory protections granted by the law that would otherwise apply, including mandatory protections of the consumer’s country of habitual residence where applicable under private international law.

(3) The courts of the Republic of Korea shall have jurisdiction to the extent permitted by applicable law. Nothing in this clause prevents a consumer from bringing proceedings before another court where such right is granted by mandatory consumer-protection or private-international-law rules. Any jurisdiction agreement made after a dispute has arisen remains unaffected.

15. Severability clause

Should any provision of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
